Job Title: Experts in Indigenous Rights, Mining, and Sustainable Development

Initiative Name: “Strengthening the National Commission on Indigenous Peoples (NCIP) to Empower Indigenous Cultural Communities/Indigenous Peoples (ICCs/IPs) in the Philippines to Meaningfully Participate and Benefit in Mining Activities within Ancestral Domains in the Philippines” under the Technical Assistance Partnership - Expert Deployment Mechanism (TAP-EDM)

Remuneration: Fees are subject to negotiation and shall not exceed established market rates.

Indicative LOE/Time Frame: October 2024 to June 2025. Between 90-110 days, to be negotiated.

TAP-EDM Description:

The Technical Assistance Partnership - Expert Deployment Mechanism (TAP-EDM) Project provides targeted, short-term (up to 12 months) technical assistance to National Government Entities (NGE) from eligible OECD-DAC countries. The Mechanism is expected to deploy over 250 Canadian experts via 80-100 technical assistance initiatives designed to resolve capacity gaps to bring about the desired changes of the recipient NGEs. Fully aligned with Canada’s Feminist International Assistance Strategy (FIAP), these initiatives will integrate gender equality, climate action/environmental sustainability, human rights, and good governance as key objectives. Canadian experts will come from all walks of life, proudly representing world-class technical human resources but also the diversity and multi-culturalism that is Canada.


TAP-EDM is a four-year C$18,750,000-million-dollar project funded by Global Affairs Canada (GAC) and managed by Alinea International.


The Initiative

The National Commission on Indigenous Peoples (NCIP) is the primary government agency of the Philippines mandated to protect and promote the interest and well-being of the Indigenous Cultural Communities/Indigenous Peoples (ICCs/IPs) with regard to IPs beliefs, traditions and institutions. The main objective of the Technical Assistance Initiative (TAI) is to strengthen NCIP’s capacity to support ICCs/IPs to better advocate for, and gain, tangible and direct benefits from mining activities on their lands, improving their livelihoods, and ensuring that their basic human rights are protected and that the environmental impacts of mining activities are sustainably mitigated. Mining is a key development sector in the Philippines, yet ICCs/IPs are often disproportionately affected by its impacts.


The TAP-EDM initiative will recruit and deploy Canadian subject matter/technical expert(s) to enhance the capacity of NCIP to better understand and assess the impact of large-scale mining projects on IPs in the Philippines. The primary objective is to support training and capacity building of NCIPs staff on specific needs, tools like Environmental and Social Impact Assessments (ESIA), and skills to better assess the impacts of mining and understand the mechanics of such projects. The initiative also includes a study visit to Canada for knowledge exchange. Ultimately, the goal is for NCIP personnel to perform better in their roles by understanding the larger context and specific challenges posed by mining projects, leading to more effective protection of the rights of the 14 million IPS and in line with the Indigenous Peoples Rights Act of the Philippines.


The Role

The selected expert(s) will play a crucial role in providing tailored support to the Ministry and ICCs/IPs to improve their understanding of the mining sector, environmental impacts, and how to protect Indigenous rights in these contexts. The responsibilities include:


1. Gap Analysis and Needs Assessment


2. Capacity Building Activities

Design and deliver training for NCIP staff on mining sector processes, critical minerals, and economic opportunities for ICCs/IPs, while also providing instruction on inclusive Environmental and Social Impact Assessments (ESIA) with a focus on Indigenous lands and communities. Equip NCIP with the skills necessary to offer technical and legal advice to ICCs/IPs during the development of key frameworks and their participation in Free, Prior, and Informed Consent (FPIC) processes.


3. Tool Development

Develop user-friendly ESIA tools that integrate Indigenous Knowledge Systems and Practices (IKSPs). Create Training of Trainers (TOT) modules for further dissemination at the regional level, and community protocols for engaging with the private sector.


4. Technical Visit to Canada

Organize and facilitate a technical visit to Canada for a delegation of NCIP key staff to explore best practices, challenges and successful development interventions related to meaningful participation of ICCs/IPs on mining activities in their ancestral domains.


5. Mentoring and Coaching

Offer mentorship and coaching during the roll-out of this initiative, ensuring the Ministry staff is well-equipped to provide ongoing technical and legal support to ICCs/IPs.


Successful candidates will also be expected to complete the TAP-EDM orientation program, develop a detailed work plan, submit progress and final reports, and promote the initiative through communications and public engagement activities across Canada.


Required Qualifications:

  • A minimum of an advanced degree or master’s degree in a social or environmental sciences discipline, i.e. environmental science, mining engineering, land management, indigenous people’s rights, or a related field. A PhD will be considered an advantage.
  • Knowledge of Indigenous cultures in Canada and leadership experience in Indigenous representative organizations or governments in Canada;
  • Extensive knowledge of Canadian federal and/or provincial free, prior and informed consent regulations and procedures.
  • Extensive experience in the mining sector, particularly in sustainable and responsible mining practices.
  • Knowledge of critical minerals, resource economics, and benefit-sharing with Indigenous communities.
  • Experience negotiating and/or defending Indigenous rights in negotiating agreements between communities and the private sector
  • Strong background in conducting Environmental and Social Impact Assessments (ESIA), with a focus on Indigenous territories.
  • Proven track record in developing and delivering training programs for government staff and Indigenous communities.
  • Broad analytical, facilitation, management and strategic planning, consultation, and collaboration skills for the promotion and creation of good relations between Indigenous communities and federal and/or provincial governments.
  • Professional English proficiency, cross-cultural proficiency.
  • Candidates with direct experience working with Indigenous Peoples in Canada or globally.
  • Demonstrated ability to work effectively with diverse and multiple stakeholders at national and international levels.
  • Demonstrated ability to work effectively and respectfully in a multicultural and multidisciplinary environment.
  • Demonstrated ability to prepare reports and manage information from different sources.
