Title: Director, Texas Regulatory Affairs

Location: Austin, Texas (US - remote) – Must reside in/near Austin, TX

Key Accountabilities:**

  • Monitor, participate and report on relevant regulatory issues, legislative actions, market developments, regulatory applications, and proceedings in Texas, with a focus toward the development of enhanced internal and external regulatory and legislative strategies, changes in rules, compliance and policies that are in support of Just Energy’s business strategies and directly or indirectly affect Just Energy.
  • Increase the Company’s presence and influence in the ERCOT stakeholder processes and at the PUCT, by actively participating in stakeholder meetings regarding capacity, energy and ancillary services market design, transmission, operations, governance, and reliability.
  • Oversee the review of proposed changes to Texas legislation and regulations, flag legislative and regulatory implications and identify potential legislative and regulatory risks to the Company’s strategic/operational plans and propose options to mitigate risks ensuring proactive steps are undertaken.
  • Develop, implement, and oversee the company’s Texas based regulatory strategies and policy development in Texas based on business requirements and corporate vision.
  • Offer regulatory evaluation and opinions on due diligence activities and provide regulatory assessment to management, including technical aspects. Coordinate internal stakeholders’ input to obtain final company position and guide the influencing of industry bodies on key areas of the market.
  • Establish, develop and maintain effective relationships with Texas regulators, utilities, market participants and policy makers.
  • Company representation/participation in key technical and regulatory meetings and committees for standards and regulations affecting the company.
  • Serve as the principal Texas regulatory contact point and work with available resources (i.e., market participants, consultants, attorneys, lobbyists, regulatory contacts, local authorities, utilities, ISO’s, TEAM, energy coalition groups and other competitive retailers) to pursue company positions in Texas.
  • Assess emerging ERCOT issues and determine if proposed solutions would be favorable, unfavorable or neutral to the Company. Ensure that appropriate internal staff are apprised of the latest rules as well as provide input as new rules are developed.
  • Communicate, coordinate, and verify successful implementation and compliance with regulations and requirements for the marketing and sale of energy, and transactional and operational rules in Texas.
  • Review and approve contracts, scripts, marketing materials, etc.
  • Work with internal personnel in development and implementation of policies and procedures related to compliance with Texas energy related regulations, including regulatory agency reporting requirements.
  • Provide guidance related to rule requirements and decision making of internal business rules and support with compliance issues and formal/escalated complaint issues.
  • Review and periodically audit as necessary compliance with all marketing, scripting, enrollment and other required contracts and customer materials, to support Just Energy’s requirements to maintain rule compliance in each jurisdiction.
  • Prepare reports for Management regarding market trends and progress reports on action plans as required.

Supply Related:

  • Provide guidance and information on complex supply related issues and ensure that the department and the company have up to date information regarding electric supply issues, including RPS and Capacity matters, so that they can better forecast risk and set current and future pricing.
  • Assist Supply with reporting of renewable energy in relation to RPS regulation and compliance matters in assigned jurisdictions.
  • Assist Supply, Structuring and other relevant departments with information and reporting on supply and capacity related issues in ERCOT, as well as cost allocation, pass-through and billing rules, and requirements.

People Management:

  • Oversee regulatory staff members.
  • Support team members with inquiries, escalations and provide direction.

Key Qualifications:

  • 10+ years of experience of prior working experience in Texas regulatory affairs and policy advocacy in a retail and wholesale energy business setting.
  • Proficient in reading, understanding, and communicating legislative and regulatory filings, rules and regulation, legislative bills, utility tariffs, and Commission issued orders. Provide feedback and make public comments in relation to the same.
  • Technical retail and wholesale understanding and experience with assessing risk associated to regulatory and legislative changes impacting the company.
  • Present and engaged market participant involved in the stakeholder process (ERCOT/Austin); participating and contributing to the output of various working groups and committees (TAC, RMS, task forces etc.).
  • Strong regulatory knowledge - capable of comprehending written regulations and how the regulations do/would affect the company’s products and processes.
  • Proven success in building and maintaining effective internal stakeholder relationships and strong negotiation skills.
  • Collaborate with relevant internal business sectors to devise business strategies to support targeted regulatory and legislative objectives, based on favored business outcomes.
  • Extensive working experience with establishing and maintaining good relationships with various governmental regulators, utilities, ERCOT, industry associations and stakeholders.
  • Excellent verbal/written communication skills and the ability to communicate complex regulatory issues and the meaning of those to a broad audience. Skilled in facilitation and presentation.
  • Think and act quickly on various urgent internal and external issues of importance to the company.
  • Excellent organizational skills and time management skills with the ability to prioritize workload and multi-task in a fast-paced environment while maintaining accuracy and attention to detail.
  • Ability to work flexible or extended working hours as needed to meet business needs; demonstrated good attendance and punctuality. Ability to work under pressure and adaptable to change.
  • Experience in observing and reporting assurance relating to compliance in line with corporate, regulatory, and legal standards, policies, and practices.
  • Preference given to candidate with an accredited degree in engineering, economics, or science; and experience in some combination of transmission operations and/or planning, electric power scheduling/trading, transmission tariff analysis, capacity, energy and ancillary services market rules, market settlements and applicable ERCOT rules.
  • Ability to travel (2-5 times a year).
  • Proficient computer skills in Microsoft Office (Word, Visio, Excel, PowerPoint, and Outlook).
