Terms of Reference
Position: Consultant – Development of Judicial Training Manual on Trafficking for Sexual Exploitation
Duration: 3 Months (estimated time between June and August 2025)
Location: Remote, preferably +/- 3 hours of Nairobi
Reporting to: Programme Officer – End Sex Exploitation
Partner Institution: International Association of Women Judges Kenya Chapter (IAWJ Kenya Chapter)

1. Background

In 2024, the International Association of Women Judges Kenya Chapter (IAWJ Kenya Chapter), with support from Equality Now, developed and launched a Bench Book on Trafficking for Sexual Exploitation in Kenya (the Bench Book) as a guide for Judicial Officers in adjudicating cases of human trafficking for sexual exploitation. The Bench Book analyses the elements of the offence, discusses the misconceptions related to trafficking for sexual exploitation, and calls on Judicial Officers to adopt a human rights-based and trauma-informed approach when handling cases of trafficking for sexual exploitation.

To enhance the utility of the Bench Book and institutionalize its use, the IAWJ Kenya Chapter seeks to disseminate it to Judicial Officers across Kenya. Equality Now will support this process and seeks to engage a Consultant to develop a Judicial Training Manual. The manual will retain the necessary legal and technical content while presenting it in an accessible, well-structured format that enables trainers to deliver consistent and accurate information during capacity-building sessions with Judicial Officers.

2. Objective of the Assignment

To develop a comprehensive and practical Judicial Training Manual grounded in the Bench Book on human trafficking for sexual exploitation, to be used in training Judicial Officers who are members of the IAWJ Kenya Chapter, comprising Judges, Magistrates, and other justice actors. The Bench Book will also be used in sessions with the Court Users Committee members in selected counties.

3. Scope of Work

Under the supervision of the Programme Officer – End Sex Trafficking and reporting to a Technical Committee made up of representatives from IAWJ Kenya Chapter and Equality Now, the Consultant will:

  • Review the Bench Book and related legal materials to identify key themes, training needs, and content areas.
  • Conduct a brief stakeholder needs assessment, including consultation with Judicial Officers, training institutions, and relevant actors, to inform content structure and pedagogical approach.
  • Present an Inception Report, which will include the methodology and content structure of the Training Manual, to a technical committee comprising members from the IAWJ Kenya Chapter and Equality Now and receive their input and sign-off.
  • Develop the Training Manual that:
    • Aligns with the Bench Book and national/international legal standards, also paying attention to aspects of technology-facilitated gender based violence relevant to sex trafficking.
    • Includes modules, facilitator guidance, case studies, case law and jurisprudence, gender-sensitive checklists, survivor-sensitive courtroom practices, and interactive learning activities.
    • Can be adapted for self-study and in-person and/or virtual facilitation.
       
  • Submit a draft Training Manual for review and incorporate feedback from the Technical Committee.
  • Facilitate a validation workshop comprising selected external stakeholders to present the manual and gather additional input.
  • Produce the final Training Manual, ready for design and layout.
    Work with the Technical Committee and Equality Now’s Communications team to address technical issues arising from the proofreading and design process.
4. Expected Deliverables
  1. Desk review and Stakeholder Consultation Report – summarizing findings from the needs assessment and key recommendations.
  2. Inception Report – including methodology, annotated outline of the manual, and work plan.
  3. Draft Training Manual – including training modules and facilitation guidance.
  4. Validation Workshop Report – including participant feedback and agreed revisions.
  5. Final Training Manual – incorporating all feedback, design-ready.
     

5. Timeframe

The consultancy is expected to run for 3 months, starting in June 2025, with the final Training Manual delivered by 30 August 2025. A detailed work plan will be agreed upon at contract signing.

6. Qualifications and Experience

Essential:

  • Demonstrated experience developing training manuals or legal education materials for Judicial Officers in Kenya and/or internationally.
  • Knowledge of trafficking for sexual exploitation, gender-based violence, or sexual exploitation.
  • A law degree, postgraduate qualifications in human rights, gender, or related fields, is an added advantage.
  • Proven ability to apply human rights-based and survivor-centered approaches in training resources.
    Excellent research, writing, and facilitation skills.

Desirable:

  • Prior experience working with judicial stakeholders in Kenya or comparable jurisdictions.
  • Experience in participatory and adult learning methodologies.
